Stock Availability
The website is updated regularly about stock availability. Whilst every effort is made to show the correct availability of stock, the stock availability shown on the website is an indication of the availability at the time of the last update and does not constitute confirmation of stock availability at time of order. We are entitled to withdraw from any contract that cannot be fulfilled due to discontinuation or lack of stock. If an item is not listed on this website, please contact your account manager or our sales team on 08 6150 8026.
Orders
After you place an order, we reserve the right to accept, refuse, cancel or limit your order for any reason, including, but not limited to, the unavailability of a product or errors in the prices and product descriptions posted on this website.
Once payment has been received, we will confirm that your order has been accepted by sending an
email to you at the email address you provide during signup. This acceptance by Toner Print of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
Should an advertised product not be available for any reason, a Toner Print representative fulfilling your order will contact you to discuss an alternative product at similar quality and price. If an alternative product is not available and payment for that product has been taken, then payment for the product will be refunded to your original payment method.
Pricing
Unless specifically advertised, all prices on this website are quoted excluding Goods and Services Tax (GST). GST will be added upon ordering goods and must be paid. Please contact your account manager or our sales team on 08 6150 8026 to order items unavailable online.
Warranty Information
In addition to the Consumer Guarantees, all products sold by Toner Print are covered by the manufacturers' warranty that accompanies the product. Toner Print makes no additional or independent warranty in addition to the Consumer Guarantees or those offered by the manufacturer of a product. If an item within warranty is deemed faulty, you may be entitled to a repair, replacement, credit, or refund, at the discretion of the manufacturer and/or Toner Print. We reserve the right to decline a repair, replacement, credit, or refund claim where any product fault is caused by misuse or neglect.
Delivery of Goods
We place great importance on the fast and reliable delivery of customers’ orders, however, please note that delivery times are estimates only and Toner Print shall not be liable for delays.
If the Customer fails or refuses to take delivery of the goods, then in addition to all other rights and remedies of Toner Print, the customer shall be liable for all loss and damage (including consequential loss and damage) suffered or incurred by Toner Print as a result thereof and Toner Print, at its discretion may charge a restocking fee.
If Authority to Leave is selected at checkout, you must specify where you would like the goods left (at the front door, next to the garage, etc). Toner Print and our couriers cannot be held responsible for goods being left unattended that go missing if an order has been authorised to leave. *Australian Air Express (AAE) will not leave goods at the door and will leave a card instead so that you can pick up your order at the nearest post office/depot if selected.
Title of Goods
The goods shall be at the customers risk at the point of delivery. The customer, upon taking delivery of the goods, shall immediately examine the goods and give written notice to Toner Print of any defect within five (5) days of such date, failing which the goods shall be deemed to have been delivered in good order and condition and accepted by the customer.
Errors and Omissions
At Toner Print, we work hard to offer you the most competitive pricing and accurate product information. Because of the dynamic nature of this industry (e.g. vendor price changes and other variables beyond our control), prices, promotions, versions and availability advertised are subject to change without prior notice. All images are for illustrative purposes only. Actual product may differ. Please be assured of our every effort to ensure the accuracy of information; however, the documents and graphics published may contain technical inaccuracies or typographical errors. Toner Print makes no representations about the suitability of this information; it is provided "as is" without warranty of any kind. If an error is made or a product is listed at an incorrect price, Toner Print shall maintain the right to refuse or cancel any orders placed. If the order has been confirmed and charged to your account or credit card, Toner Print shall immediately issue a credit or refund.
Limitation of Liability
Toner Print shall under no circumstances, except where the consumer guarantees apply, be liable for special, incidental, or consequential damages including loss of profit or opportunity, even if it has been advised of the possibility of such damages; the maximum liability for all direct damages, if any, arising out of any action shall be limited to an amount not to exceed the purchase price of the product.
Governing Law
All sales shall be deemed made in the state of WA, regardless of the location of the customer. The customer agrees that any dispute with Toner Print shall be governed by the WA law and the customer irrevocably submits to the exclusive jurisdiction of WA courts and courts hearing appeals from those courts.
General
To the extent any section or portion of a section of these Terms and Conditions of Sale are deemed unlawful or unenforceable, that section or portion of a section shall as far as practicable be read down or stricken from the Terms and Conditions of Sale, so that the remaining terms can continue in full force and effect.
Cancellation Policy
If you need to cancel your order, please contact our customer service team within 14 days of the order date. Orders that have not been shipped or are not in the process of being shipped are eligible for cancellation. Please note that a 20% restocking fee will be invoiced or deducted from your refund to cover processing and handling costs. Refunds will be processed to the original payment method within 7-10 business days after the cancellation is confirmed. Custom or personalised orders, as well as items marked as non-refundable or final sale, cannot be cancelled.
Return of Equipment at Subscription End
Obligation to Return Printers
Upon the expiration or termination of a printer subscription, the Customer is required to return the printer and any associated equipment provided by Toner Print ("Equipment") in good working condition, subject to reasonable wear and tear. Failure to return the Equipment within 14 days after the subscription end date may result in additional fees, including but not limited to, the full replacement cost of the Equipment.
Exclusion of Toner Products
This return obligation does not apply to toner subscriptions. Toner products supplied under a toner subscription are not required to be returned at the end of the subscription period.
Return Process
Toner Print will provide instructions on how to return the Equipment for printer subscriptions, including packaging requirements and designated return shipping methods. The Customer is responsible for ensuring that the Equipment is securely packaged to prevent damage during transit.
Unreturned or Damaged Equipment
If the Equipment is not returned within the specified period or is returned in a damaged condition beyond reasonable wear and tear, Toner Print reserves the right to charge the Customer a non-return fee or a repair/replacement fee, as applicable. These charges will be communicated to the Customer prior to processing.
Ownership
All Equipment provided under the printer subscription remains the property of Toner Print at all times. The Customer does not acquire any ownership rights to the Equipment, and any attempt to sell, transfer, or dispose of it is strictly prohibited.
Changes to this policy
We reserve the right to modify this policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. It is the responsibility of the customer to read and understand these terms and conditions each time an order is placed.
